Phase I - Indigenous-to-Indigenous Business and Legal Knowledge Exchange Project In the past, worldwide efforts have been made to introduce equality and fairness into extraction industry (mining, oil, timber etc.) relations with indigenous peoples upon whose land the industries operate. To date, few—if any—countries have succeeded to achieve that goal to the level achieved in Canada. While the relationships are far from problem free, the indigenous people of the Northwest Territories have established equilibrium between their access and land rights, and the economic opportunities represented by the extraction industries. In Colombia, while the stakeholders all appear to have the same goals of fairness and cooperation, success in those realms, to date, remains elusive. The International Bar Association (IBA), through its Indigenous Peoples Committee, tested the theory that indigenous people speaking to other indigenous people had the greatest chance of success. These “one-to-one” exchanges were focused on allowing people to speak to their peers—people who have actual experience rather than academic or vicarious experience. On a project funded by the IBA, a focus group comprised of Colombian and Canadian nationals travelled to and throughout Colombia meeting with the country’s indigenous people and representatives of the mining industry. It was the hope of the contingent that through sharing the experiences of the indigenous people of Canada, a new way to achieve equality and fairness between the indigenous people in Colombia and the mining industry could be realized.
