FULL HEARING | Felony charges against Lorain County Prosecutor J.D. Tomlinson dismissed by judge

Felony charges against Lorain County Prosecutor J.D. Tomlinson and his chief of staff James Burge, which included intimidation and evidence tampering, were dropped Friday after the complaining witness failed to comply with a subpoena to appear at the preliminary hearing. Visiting Judge Patrick Carroll refused a request by special prosecutor Ron O'Brien in Elyria Municipal Court to issue a warrant for the arrest of the witness, an ex-employee/girlfriend of Tomlinson. "I feel that the evidence has not been sufficient to determine if this court has authority over her at this time. She's not a party. I will not issue a warrant under the circumstances," Carroll stated. Upon the ruling by Carroll, a retired Lakewood Municipal Court judge, many of Tomlinson's supporters seated behind him erupted in cheers, causing Carroll to order them to leave the courtroom.
