On Monday March 22, 2021 at approximately 1320 hours I was patrolling I-75/85 South near Edgewood Avenue in the city limits of Atlanta in Fulton County Georgia. I observed a silver in color Buick Lacrosse bearing Georgia dealer tag WUQ797 traveling south on I-75/85 South in the second lane from the median wall. The Buick matched the description of a vehicle that had fled a traffic stop being conducted by Atlanta Police Department Unit 5845 several minutes prior. Atlanta Police Department Zone 5 radio gave the last direction of travel as south on Spring Street heading toward I- 75/85 South. It was also stated over the radio that the license plate affixed to the Buick was reported stolen. After observing the Buick pass by my location with the flow of traffic I gradually positioned my patrol vehicle behind the Buick. When I was several car lengths behind the Buick without any emergency lights or siren activated on my marked Georgia State Patrol vehicle, the hazard lights on the Buick were activated. The Buick then made several lane changes to the right before traveling onto the right shoulder. I followed the Buick onto the shoulder and activated my flashing blue emergency lights. The Buick did not stop on the shoulder. The Buick then traveled back into the travel lanes and continued south on I-75/85 South. I followed the Buick which began to accelerate. I notified Troop C Communications that I was behind the Buick with a license plate that was stolen and that it was not stopping. With my flashing blue emergency lights and audible siren activated, the Buick failed to yield. I notified Troop C Communications that I was in pursuit of the Buick. The Buick continued south on 1-75/85 South before exiting onto GA-166 West. The Buick failed to maintain lane multiple times as it weaved in and out of traffic. At the Sylvan Road exit, the Buick exited and turned right without stopping at the stop sign. The Buick then made an immediate left turn onto Estes Drive SW, where it stopped on the right side of the road. The driver and only occupant of the Buick exited the driver door and began running north on Sylvan Road SW. I gave multiple loud verbal commands to the driver to stop and get on the ground. The driver did not comply. I then warned the driver approximately ten times that he was going to be tased. The driver continued running. Near the address of 1975 Sylvan Road SW the driver ran westbound across the roadway and down a drainage ditch embankment. The driver stumbled as he traveled down the rocky and steep embankment lining the ditch. As the driver reached the bottom of the ditch, he regained his footing and attempted to continue fleeing on foot. I then deployed my agency-issued taser. The two probes of the taser made contact with the driver's back. The driver was immediately incapacitated. I instructed the driver to place his hands behind his back. The driver complied and I placed the driver in handcuffs. The driver stated he had a handgun in his pants pocket. I located a loaded Glock 380 caliber handgun with serial number ADBZ513 in the driver's right pants pocket. I then assisted the driver to his feet and up the embankment. On the walk back to my patrol vehicle the driver identified himself as Leanthony Hutchinson. Once back at my patrol vehicle, a wallet was located in Mr. Hutchinson's pocket that contained a Georgia identification card confirming his identity. An ambulance was requested to the scene to evaluate Mr. Hutchinson following the taser deployment. Grady EMS arrived and removed the taser probes. Mr. Hutchinson was then secured to a stretcher with handcuffs to be transported in the ambulance to Grady Hospital following the completion of the processing of the Buick. The Buick was searched by Georgia State Patrol Sergeant K. McKoy. A Georgia temporary license plate was located in the Buick. The license plate matched the Buick, but was expired. Mr. Hutchinson stated he was given the stolen dealer tag by a friend but stated he did not know it was stolen. Mr. Hutchinson stated he placed the dealer tag on the Buick knowing it was not registered to the Buick because his temporary tag was expired. A tow receipt was completed by Sergeant McKoy and the Buick was towed from the scene by South Metro Towing. Troop C Communications advised the Glock that was recovered was reported stolen. The Glock was taken into evidence at the scene. Confirmations of the stolen license plate and firearm were completed by Troop C Communications. Mr. Hutchinson stated he bought the gun on the street and guessed it was likely stolen. I asked Mr. Hutchinson if he was previously convicted of any felonies. Mr. Hutchinson stated he was on parole. A criminal history for Mr. Hutchinson was completed by Troop C Communications. The criminal history indicated Mr. Hutchinson had been convicted on theft by receiving stolen property by Georgia Department of Community Supervision in Fulton County on January 7, 2019.
