A public interest litigation (PIL) has been filed in the Supreme Court challenging the new UGC rules, alleging that the UGC has exceeded its jurisdiction by framing provisions that are against the basic structure of the Constitution, the autonomy of universities, and freedom of expression. The petition seeks to declare these rules unconstitutional and requests a stay on their implementation. The petition has been filed by Mrutunjay Tiwari, a student of Banaras Hindu University. The petitioner argues that while the objective of equality and social justice is important, rules cannot be framed to achieve this objective that restrict rights protected by the Constitution or fill the academic environment of universities with fear and insecurity. The UGC, however, maintains that these rules will help prevent caste-based discrimination against Scheduled Caste, Scheduled Tribe, and Other Backward Classes students. The rules even include provisions for the UGC to revoke recognition if institutions fail to comply.
