Little, Brown & Co. | 685 F.2d 870 (3d Cir. 1982) In the early 1980s, several video game manufacturers filed a series of lawsuits attempting to stop competitors from selling knock-off versions of popular video games. Williams Electronics, Incorporated versus Artic International, Incorporated considered whether one of the most popular video games of all time was a victim of copyright infringement. Williams Electronics manufactured and sold video games for coin-operated game consoles. In 1980, Williams introduced the popular video game Defender and registered three aspects of the game for copyright protection: the computer program, the audiovisual effects displayed in the game’s attract mode, and the audiovisual effects displayed in the game’s play mode, which included how a player interacted with the game. Copyright notices were displayed on the game’s cabinet and appeared on the screen during the attract and play modes and on labels attached to the outer casing of each memory device. Artic International sold a computer game called Defense Command, which was virtually identical to Defender in both the attract and play modes. Williams sued Artic, alleging that Defense Command infringed upon Williams’s Defender copyrights. The trial court found for Williams and issued a permanent injunction against Artic’s infringement of audiovisual copyrights. Artic appealed. Want more details on this case?
