The bank cannot unilaterally increase the interest rate on the loan. A stipulation allowing the bank to increase the interest rate unilaterally is a potestative condition which violates the principle of mutuality of contract and as such is null and void. It would be valid if the successive increase in interest is with the written assent of the depositor or the borrower and it would be void if the supposed consent is given prior to the increase of the interest rate.
