While it sounds simple, lenders and foreclosure trustees often deny requests due to technicalities. To avoid being denied, homeowners must follow strict requirements: Applies only to trustee sales (not judicial foreclosures or sheriff sales). Property must be residential (4 units or fewer). Listing agreement must be sent to the foreclosure trustee (not the loan servicer) and signed by the trustor (the borrower on the deed of trust). Agreement must be delivered at least 5 business days before the sale date, using certified mail or an overnight courier with tracking and signature confirmation. Listing broker must be a licensed California real estate broker. Property must actually be listed on the MLS or another marketing platform at least 5 business days before the sale.
