The thesis presented in this talk is that law must be rooted in moral principles and that Kant’s categorical imperative is the test we must apply in order to confirm the legitimacy of law. By comparing and contrasting law and ethics, William Cohn shows that amoral law has been and continues to be a menace to peace, liberty, and security. It is argued that the shortcomings of Rule of Law are best resolved through application of Immanuel Kant’s moral reasoning theory, and that this theory must be the basis for the progress in international law which is needed to meet the great global challenges of the 21st century. William A. Cohn, J.D. a member of the California Bar, is a professor of jurisprudence at New York University, and a lecturer on law, ethics and critical thinking at the University of New York in Prague. An attorney and constitutional law scholar, Mr. Cohn has practiced and taught law since 1993, working with clients, judges, international organizations, bar associations and scholars, lecturing and publishing extensively on matters of law and policy. Mr. Cohn’s scholarship focuses on law and ethics, and on innovative methods to promote critical thinking skills, media literacy, and the rule of law.
