Utah prosecutors will remain on Tyler Robinson case, judge rules

A Utah County prosecutor's office will be allowed to proceed with its death penalty case against Tyler Robinson, the man accused of killing Charlie Kirk. The judge made the ruling Tuesday, following arguments that prosecutors mishandled a potential conflict of interest. Because defendant has not established a factual basis for finding a conflict of interest or an objective appearance of impropriety rising to a constitutional concern, his motion is respectfully denied," said Utah District Judge Tony Graf. The defense team for Robinson wanted the entire Utah County Attorney's Office removed after learning one of its prosecutors, Chad Grunander, had a child who was at the Turning Point USA event where Kirk was assassinated in September 2025. They argued that the child's presence influenced the case. "The court is unpersuaded that Mr. Grunander’s relationship with (his child) creates an appearance of bias in this case," Graf said. The judge did admonish the prosecution office and said that they should have screened off that one prosecutor from any death penalty decisions and said that the failure to do so was not fatal and the case could proceed without disqualification," said Neama Rahmani, President of West Coast Trial Lawyers.
