Today, we have DAY ONE of SIX days of testimony in an EPIC length evidentiary hearing that takes place when Mom files a motion for reconsideration after the court decides to change custody based on an FOC report that recommends that Dad have custody during the week because evidence from the school shows that their daughter has had so many unexcused absences from school that she’s been found truant in the past, and the vast majority of the lates and tardies she has had have been during Mom’s custody time. Dad’s lawyer says he is also worried about the people that Mom allows around their daughter and the state of the home that they live in. There has also been some questionable behaviour by Mom that makes Dad and others wonder if she is struggling with substance abuse. Mom is a mess, who breaks down crying at the start over not having her lawyer show up. The legal aid lawyer that she claims should been helping her out is a no-show for the hearing and hasn’t entered an appearance. She says she doesn’t know what to do, but the referee tells her she’s had months and months to prepare for this hearing so she’ll just have to have to do it herself.
