DUI defense attorney Neil Shouse explains why DUI of marijuana charges are easier to beat in court than DUI of alcohol. Even though marijuana is legal in California, driving while under the influence of marijuana is illegal, and treated very similar to DUI of alcohol. If convicted, first time DUI of marijuana carries probation, fines, DUI school, driver's license suspension, and occasionally even jail time. However beating a charge of DUI of marijuana is much easier than beating a DUI of alcohol charge, for a few reasons: Firstly, in California there is no "per se" limit for DUI of marijuana. DUI of alcohol sets a strict limit of .08. But for marijuana there is no specific threshold for marijuana in the blood. This forces the prosecution to come up with other methods to try to prove that a defendant was driving under the intoxicated on marijuana. Second, the blood tests for DUI of marijuana do not give enough information to prove that someone was intoxicated at the time of driving. Marijuana blood tests only show metabolites in blood, that prove some time in the recent past a person had smoked marijuana. However since marijuana metabolites can last in someone's body for up to 30 days, it is hard for the prosecution to prove that the defendant was driving while intoxicated on marijuana. Lastly, there is no reliable scientific evidence that proves that marijuana causes a person to drive worse, or that stoned drivers cause more accidents than sober ones. Police and prosecutors have dubious claims to the contrary, attempting to show that marijuana impairs someone's motor skills, but their own evidence is contradictory, and at times proves that drivers who are high on marijuana are no worse drivers than sober ones.
