A mistrial is a serious remedy to a problem that arises during a jury trial. Courts are reluctant to grant them. A jury trial has started but something so bad has happened that the judge needs to pull the plug. If the other side asks for a mistrial, and it's granted, it can be devastating. It takes years to get to trial and often costs lots of money and the parties now must start the trial over again. On the other hand, if the insurance company or defense lawyer does something unfair to prejudice my client, the plaintiff, then sometimes you need to ask for a mistrial. Depending on how bad the misconduct was, you might be able to ask for them to pay for your costs and fees in some jurisdictions. Jordan Redavid, Esq., is a serious injury and wrongful death lawyer licensed to practice law in Florida and Georgia.
