Land The Bombay High Court has given a landmark judgement wherein they have ruled that existing members have to be given 35% free fungible area on existing Built-up area. This area cannot be used for any other purposes. With this judgement, it is now for the Municipal authorities viz. the Building Planning dept., builder/Developer and the CHS committee members - to ensure that this area is given to the existing members in the rehabilitation area. Otherwise they will be liable for contempt of court. There is another 15% Incentive FSI or 10 sq.m. per member, whichever is more, that has to be given to existing occupant member.
