77-Year-Old Woman is Almost 4 Times the Legal Limit at 12 Noon

On February 13, 2025, at around noon, Las Cruces Police Sgt. Allen responded to a call involving a single car accident in a parking lot. Staff from a medical office had called the Las Cruces Fire and Police Department to report an intoxicated woman who had jumped a curb and flatten her tire. When Sgt. Allen arrived, EMS had already medically cleared the 77-year-old woman. Because of her level of intoxication, she was unable to perform field sobriety tests. She was placed in the back of Sgt. Allen's patrol vehicle and was arrested for Driving While Under the Influence (DWI). At the police station, she was able to complete one breath alcohol test, which registered 0.30% BAC. However, because she was unable to complete the second required breath test, she was deemed to have refused, and she was charged with Aggravated DWI (2nd offense). All suspects are presumed to be innocent until proven guilty in a court of law.
