If you have you have been arrested for a DWI in Texas, you are likely wondering how long it is going to take for you to resolve your case – weeks? Months? Years? This is an important question to ask because many people have the idea that you show up to your first court date for a DWI in Tarrant County and you will decide to plea or take it to trial in a single court setting. Unfortunately, it does not work that way. Having worked as a former prosecutor that worked at the Tarrant County District Attorney’s Office for over 5 ½ years and I had a pretty good idea how the prosecutor would be dealing with a DWI case. Normally, prosecutors have a large caseload to manage and have spent very little time on any one case for the first few months after an arrest. Usually, the prosecutor will make a “safe” offer on the case in the event you want to take care of your case but it is usually not the best result available. The prosecutors are handling hundreds of cases at a time and you are just a number to them when the case begins. Your lawyer must make your case a priority to them. That requires time. It requires pointing out problems with the case and negotiating at each court date to move the offer on the case in a positive direction. In order to get the best result on a DWI case, you will likely have to push the prosecutor closer to a trial setting before all the options available to you will be made available. This requires an aggressive attorney that will push the case as far as it needs to go in order to get the desired result. Here at the Hampton Law Firm we many times have do just that. We are willing to aggressively push the case as far as it needs to go – even to trial if that is what it takes.
