FormGen Inc. | 154 F.3d 1107 (1998) With the widespread popularity of video games, customization technologies are also on the rise. But why is that permissible if gaming companies hold the copyright to these games? The nineteen ninety-eight case of Micro Star versus FormGen, Incorporated explores this question in the context of a postapocalyptic fantasy world. FormGen, Incorporated, created and distributed a wildly popular video game called Duke Nukem Three D. In the game, players take on Duke’s perspective as a beefy soldier-type and evade aliens in a futuristic setting, while trying to navigate to the next level. There are twenty-nine levels in the basic version of the game. Each level includes various combinations of aliens, scenery, and other features. The game, its characters, its levels, and scenarios were protected by copyright, in which FormGen retained all rights. The game also included a feature to build one’s own level, and players often posted their customized levels online for others to download. FormGen encouraged this. Software distributor MicroStar downloaded and stored three hundred of these customized levels onto C Ds and packaged them for sale. The level files burned onto the C Ds had to be played through Duke Nukem. These C Ds were sold under the name Nuke It, and the packaging featured several photos of the three hundred downloaded levels. MicroStar filed a motion in district court requesting a declaratory judgment that Nuke It didn’t infringe upon FormGen’s copyright, and FormGen filed a counterclaim requesting a preliminary injunction to stop MicroStar from producing or distributing Nuke It. The court determined that Nuke It wasn’t a derivative work of FormGen’s game and, therefore, didn’t infringe upon its copyright. However, the court did issue a preliminary injunction with respect to the pictures on the Nuke It packaging, finding that MicroStar infringed upon FormGen’s copyright when MicroStar reproduced the screenshots without a license.
