Wait a Little Longer – A Ballad for Law and Liberty

“Wait a Little Longer” is a cinematic protest ballad about the fragile thread between justice and power. It calls for patience, courage, and faith in the rule of law when fear threatens freedom. Inspiration for this song: The U.S. judge who said to “wait just a little while longer” and requested a full Ninth Circuit review was Judge Susan Graber of the Ninth U.S. Circuit Court of Appeals.​ She made this statement in reference to the October 20, 2025 Ninth Circuit panel ruling that allowed President Donald Trump’s administration to deploy National Guard troops to Portland, Oregon, despite ongoing challenges from the state and city officials. Judge Graber dissented from that ruling and joined Oregon Attorney General Dan Rayfield in urging the full Ninth Circuit to act “en banc”—meaning all active judges on the court would review the case collectively, rather than the smaller three-judge panel. Judge Graber’s dissent specifically asked the public to keep faith in the judicial process “for just a little while longer”, emphasizing concern that the panel’s decision could authorize an “illegal deployment of troops under false pretenses”.​ As of October 21, 2025, the full Ninth Circuit has been asked to consider an en banc rehearing of that decision.​ DISSENT BY JUDGE GRABER: I strenuously dissent from the panel majority’s decision to grant a stay that permits the federalization and deployment of National Guard members in Portland, Oregon. At every stage, the government has failed to provide evidence that either (a) “the President is unable with the regular forces to execute the laws of the United States” or (b) that such an extraordinary intrusion on state sovereignty is justified under 10 U.S.C. § 12406(3). The facts on the ground, as reflected in the record, show that federal law enforcement, supported by the Department of Homeland Security and local officials, was able to maintain law and order at the Lindquist ICE facility. The notion that Portland became a “war zone” is unsupported by the frequency and context of the incidents referenced by the government, many of which are isolated, exaggerated, or resolved without military intervention. Critically, the government's appeal did not address—let alone contest—the district court’s second temporary restraining order, which expressly prohibited any National Guard deployment regardless of federalization status. The government appears to hope that, by prevailing here, it can sidestep further judicial scrutiny. The law, however, does not grant this court the option to ignore ongoing restraining orders merely because they have not been appealed. If the executive wishes to deploy troops in defiance of such orders, it must follow the proper legal process. There is a grave risk in granting the president unilateral power to deploy the National Guard based on vague or speculative threats. If the decision is left unchecked, today’s ruling sets a precedent that could erode the separation of powers and state sovereignty, inviting further executive overreach in future crises—real or imagined. I urge the parties and my colleagues to have faith in the judicial process for just a little while longer.
