The Supreme Court decision in R. v. Gladue, [1999] 1 SCR 688, was an important step by the Highest Court of the country to recognize the importance of Indigenous background on an accused person. But how much are the principles that were enunciated in Gladue actually being applied? Do we as justice system participants grasp the importance and true meaning of these principals? In this interview, the Honourable Justice Brock Jones from the Ontario Court of Justice, defence counsel Shaunna Kelly and Emily Hill, Director of Aboriginal Legal Services in Toronto talk about Gladue Court. The issues discussed range from what is Gladue Court and why it exists, to what’s different from a defence perspective about Gladue Court, to who is Gladue court meant for. Are Crowns living up to the values of Gladue Court? These are some of the many issues that are discussed in this interview in the context of a rich discussion about Gladue Court and principles. This interview is a must see for criminal lawyers representing Indigenous clients or who would like to represent Indigenous clients and may feel intimidated of doing so. #Gladue #Indigenous #Law #Rules #Courts #Justice
