While patrolling the area of Interstate 630 westbound near mile marker #5, I observed a red Chevy Cruze, Vehicle 1, driving erratically. I observed the vehicle driving in the #3 traffic lane (fast lane), suddenly cut across all traffic lanes, and took exit #5. Exit #5 is a (1) one-lane exit ramp. A white SUV stopped on the exit ramp, waiting to merge into traffic on University Avenue. Vehicle 1 drove around the White SUV on the right shoulder. I caught up to the vehicle and initiated a traffic stop at Midtown Road and south McKinley Street. I made contact with the driver, Anthony Joseph. Mr. Joseph was very irate, and I had difficulty understanding his words. Vehicle 1’s windows were very dark due to the window tint. The windshield was also tinted, and the weather was overcast, making it difficult to see inside the vehicle. Mr. Joseph continued to argue with me about the reason for the traffic stop; his movements were sudden, and he did not comply with my verbal commands. I decided to remove Mr. Joseph from the vehicle for my safety. When Mr. Joseph exited the vehicle, I was able to see more clearly what he was wearing. Mr. Joseph was wearing an all-black uniform, a bulletproof vest with Loomis patches on the front and back, and a handgun on his belt. When I instructed Mr. Joseph to place his hands on the front of my unit, he refused. He reached inside his vest and pulled out his cell phone. Mr. Joseph refused all commands to put the cell phone down and placed his hands behind his back. While I was attempting to place Mr. Joseph into handcuffs, the front passenger, Angela Joseph, exited the vehicle and began to approach me. Mrs. Joseph refused my commands to stay back and get back inside the vehicle. While placing Mr. Joseph into handcuffs, he threw his cell phone at Mrs. Joseph, which caused it to strike the ground and break. I was able to place Mr. Joseph into handcuffs (double locking and checking for tightness), remove the handgun, and place him in the back seat of my unit. During this time, Mrs. Joseph ignored my commands to get back and stayed close to me. Due to her actions, I detained Mrs. Joseph by holding her against the front of my unit until additional units arrived. After further investigation, I determined Mr. Joseph was not impaired but was choosing to be uncooperative and argumentative. I issued Mr. Joseph citation # 100A2798645 for the traffic violations. Mr. and Mrs. Joseph were released without further incident.
