Injury lawyer Scott DeSalvo shares two case stories to help clients understand realistic timelines for settling injury cases. First, he discusses a client who was told by another lawyer that his case could be settled in 60 days—an unrealistic promise, especially as the client was still receiving treatment. Scott emphasizes that settling a case while treatment is ongoing is impractical since full recovery and medical records are crucial for accurate case valuation. On the other hand, he shares an experience with a client who fired him, even though they were close to a settlement offer. Scott explains that finalizing a settlement within 60-90 days of completing treatment is exceptionally fast for most cases; however, certain factors, such as waiting on medical records, can affect the timing. He advises clients to be patient and realistic about case timelines and reminds them of the importance of working closely with their lawyers to achieve the best outcome. Unrealistic Expectations from Other Attorneys: Scott DeSalvo recounts a case where another attorney promised a client to settle a case would be settled within 60 days while the client was still undergoing treatment, which is deemed unrealistic. Injury cases cannot be settled until treatment is complete or the condition stabilizes. Firing and Case Mismanagement: DeSalvo discusses being fired by a client despite handling the case efficiently. The client’s treatment ended in March, and by May, DeSalvo’s team had completed a medical summary and prepared a demand letter within 60 days—an unusually fast timeline. The client’s impatience led to the case being handed off, although Del Salvo retained a lien for his work. What Constitutes a Reasonable Timeline: A case timeline from treatment completion to an offer within 60–90 days is considered extremely fast. Lawyers cannot realistically settle cases immediately after injuries due to medical documentation and treatment requirements. Rare Cases of Quick Settlements: He mentions exceptions where cases were resolved in a day but emphasizes these are rare and require complete documentation upfront. We hope you enjoyed this video.
