This podcast discusses the purpose a Pre-action Protocol letter for Judicial Review. What is a Pre-action Protocol letter for Judicial Review? Hello, my name is Ali Zaidi and welcome to the second episode of our new series, Immigration Now. Today we will discuss the purpose of a pre-action protocol letter for Judicial Review. A pre-action protocol for Judicial Review Is normally in the form of detailed representations which challenges an action taken by the UKBA and threatens that a JR application will be lodged if a satisfactory response is not received The pre-action protocol is the claimant's notice of intention of a potential Judicial Review application and it provides the claimant an opportunity to present their grounds for dispute against a decision to the UKBA. The pre-action protocol should provide a clear account of the decision being challenged and a summary of the facts on which the claim will be made. Also any relevant case law and relevant UK immigration rules should be raised in the pre-action protocol letter. Please take note that a pre-action protocol letter should be sent to the Judicial Review Unit (JRU) and the UK Immigration office dealing with the client's case. You are normally required to give the UK Border Agency 14 days "pre-action notice" prior to making a judicial review application. This time limit is extremely important because if you fail to follow it there may be a costs order issued against you. In general, an application for judicial review must be lodged within three months of the date of the decision or the date when the grievance arose. In practice the UKBA are currently failing to respond to pre-action protocol letters and therefore if it is necessary to apply for Judicial Review within 3 months of the date of decision.
