The court takes approximately 95 days to approve the repayment plan after the petition is filed and the filing fees are paid. An automatic stay takes effect once a person files for bankruptcy under chapter 13. The automatic stay prevents foreclosure, repossession of property, and the initiation or continuation of any lawsuits. It also prohibits the creditors from taking any legal action against debtors for the default payments. Chapter 13 bankruptcy allows the debtor to modify the original mortgage agreement which is called mortgage modification. The debtor does not necessarily have to complete paying the full mortgage within five years, but the default payments must be settled within the time. Individuals filing Chapter 13 are required to take and complete two credit counseling courses. The first course must be completed within 180days prior to filing for Bankruptcy. The second course is required after the bankruptcy petition is filed.
