The officer who struck and killed college student Jaahnavi Kandula on January 26, 2023, has been fired from the Seattle Police Department. In a statement released Monday, the Seattle Police Department (SPD) said Kevin Dave was terminated after the Seattle Office of Police Accountability (OPA) completed its investigation. The OPA waited until both criminal and civil infraction cases were complete before completing its investigation. The OPA investigation found Dave violated the following SPD policies: 5.001 - Standards and Duties, 5.001-POL-2. Employees Must Adhere to Laws, City Policy, and Department Policy 13.030 - Emergency Vehicle Operations, 13.030-POL-3. Dave was responding to a 911 call on Jan. 23, 2023, when he came down Dexter Avenue at 74 miles per hour in a 25 mph zone and collided with Kandula, leaving her with fatal injuries. The case was investigated for more than a year before King County Prosecuting Attorney Leesa Manion declined to file charges, writing that “we lack sufficient evidence under Washington state law to prove a criminal case beyond a reasonable doubt.” In March of 2024, the Seattle City Attorney issued a $5,000 traffic fine against Kevin Dave, whose patrol vehicle struck and killed 23-year-old Jaahnavi Kandula. An investigation showed Dave was going triple the speed limit at 74 mph as he headed to an overdose call on Jan. 23, 2023. As he approached Thomas Street at Dexter Avenue North, dashboard camera video showed Kandula crossing the street in front of the officer. According to a report released in June, Kandula had the right of way at the time of the collision. Investigators later determined that Dave tried to avoid the collision by slowing down, but Kandula was still hit at 63 mph. According to the report, Dave did not have his siren activated at the time of the collision. Instead, the officer "chirped" his siren at the intersection. He did have his emergency lights on, according to the SPD. In February of 2024, the King County Prosecuting Attorney's Office announced its decision not to file criminal charges against the officer. Nine days later, the Seattle City Attorney issued a $5,000 traffic infraction against him. A check of court records shows Dave had to pay the infraction by May 13, 2024. As of the evening of May 14, 2024, court records marked his infraction as "committed," meaning it's gone into default status.
