In the case of In re Text Messaging Antitrust Litigation, the Seventh Circuit granted an interlocutory appeal and considered the standard required to state a claim for price-fixing. Consumers filed a class-action lawsuit against the country’s major wireless-phone carriers. The consumers alleged that the carriers conspired to fix the price of text-messaging services, in violation of the Sherman Antitrust Act. The consumers moved to file an amended complaint. The carriers objected, arguing that the complaint failed to state a claim. The district court granted the consumers’ motion. The carriers asked the district court to certify, for interlocutory appeal, the question of the sufficiency of the consumers’ complaint. The carriers argued that the complaint didn’t meet the standard for pleading set forth by the United States Supreme Court in Bell Atlantic versus Twombly. However, the consumers asserted that an interlocutory appeal was inappropriate, as it didn’t present a controlling question of law. The district court agreed that the carrier’s interlocutory appeal should be heard, holding that the application of Twombly was a question of law that remained unclear. However, the Seventh Circuit also had to agree to hear the appeal. Thus, the issue was brought before the Seventh Circuit. Want more details on this case?
