MYSTICA'S CROSS-EXAMINATION RE TARLAC SHOOTING! POLICE SENIOR MASTER SERGEANT JONEL NUEZCA IS NOT A CRIMINAL, HE IS A CIVIL HERO! - MYSTICA As a civil right activist, I never back down in my stand to dedicate my life to achieving justice not only for Police Master Sergeant Jonel Nuezca but for the dignity, integrity and honor of all the People in Authority or the members of the Law Enforcement Agencies. THE TARLAC SHOOTING IS AN ISOLATED CASE! This one-off case doesn't represent any general or specific pattern and otherwise described as "a case unique on its own facts". FACTS: The isolated incident that happened in Tarlac started over initiating "boga" explosive by Frank Gregorio along with his family. The impact and effect of this explosive bamboo cannon especially on children is complex, destructive and very disturbing. As a person in authority exercising power or command against this illegal initiation of explosive, Master Sgt. Jonel Nuezca, although at that time was off-duty, had acted upon the request of his daughter who had conferred authority for the purpose of maintaining peace and order in their area. Based on the circumstancial evidence recorded on videos, Nuezca is just a VICTIM OF CIRCUMSTANCES as the whole situation was being manipulated by the Gregorio family. They were the ones who started videotaping the confrontation threatening Nuezca that they would report him to Raffy Tulfo and the said videos were intended to humiliate him in public. RESISTING OR OBSTRUCTING A POLICE OFFICER IS AN OFFENSE. Based on the published videos, the conduct of both the mother and son prevents the police officer from carrying out his duties or makes it more difficult for him to perform his job to deliver the offender to the proper authorities with legal or reasonable grounds. While Master Sgt Jonel Nuezca was waiting for the barangay officials in order to respond to this case and take-over the very awkward situation, certain commotions took place. Nuezca was not arrogant but had established his way to control the son from escaping by means of holding-on to his pants. It was very clear on the video that while the mother was showing a sign resisting to surrender or give away his son to the proper authority, both the son's hands were given freedom to move and do some actions while having confrontation with the police officer inflicted with defamatory words to insult his identity as a policeman that had produced alarm or discomfiture on the part of Nuezca. CRUELTY is an ACT BY WORD imposed by the son Frank which degrades or demeans the intrinsic worth, honor, dignity and integrity of Master Sgt. Nuezca as a human being and as a police officer. The words 'I DON'T CARE eh eh eh eh eh" coming from mother Sonya's mouth as an answer to the statement, "MY FATHER IS A POLICEMAN" from Nuesca's daughter is the CAUSE OF HIS ACTION to pull the trigger due to his moral, professional, mental, emotional and psychological injury. It was clearly a VERBAL ASSAULT inflicted by the mother or an imputation with intent to defame, embarrass, frustrate or insult the police officer... and as an effect or result, the mother and son were both laid to rest to keep their mouth shut forever! Because Nuezca was also aware that the videos were going to be all over the social media, he made a decision to kill and go to jail instead of being humiliated by the mother and son with intent to embarrass his dignity, honor, integrity and profession as a police officer. THE ISOLATED CASE OF SENIOR MASTER SERGEANT JONEL NUEZCA IS JUSTIFYABLE. THE KILLING WAS COMMITTED AS A PROFESSIONAL AND SELF- DEFENSE IN THE ABSENSE OF MALICE, BROUGHT ABOUT BY REASONABLE PROVOCATION, OR DIMINISHED CAPACITY. In law, provocation is when a person is considered to have committed a criminal act partly because of a preceding set of events that might cause a reasonable person to lose self control. It affects the quality of the person's state of mind as an indicator of moral blameworthiness. Provocation is often a mitigating factor in sentencing. It rarely serves as a legal defense, meaning it does not stop the defendant from being guilty of the crime. It may however, lead to a lesser punishment.
