The FDA sent out five warning letters recently to companies that were selling Delta-8 products and marketing with pretty darn outrageous disease claims. Now, this comes on the heels of a consumer update that the FDA sent a little while ago, where they expressed concern about the safety of Delta-8 products. This includes the risk of potential solvents that are used in the extraction process of Delta-8 such as toluene and child protective packaging or the lack of child protective packaging. What happens if someone like a child consumes a large amount of Delta-8? This could be potentially hazardous to their health and also pretty darn scary. So these letters did not come as a surprise to anyone who's paying attention. They're companies that are making very high risk disease claims. So some learning targets here are these disease claims were made in social media posts. And some of these social media posts were three years old. So a friendly reminder to clean up old social media posts. The FDA looks at a very old social media post in the same manner as a current one. Also, it's another friendly reminder that claims made on blogs are considered marketing claims and therefore should be compliant. So again, this is not a surprise to anyone who's been paying attention, and I expect to see more of these Delta-8 related warning letters coming out. And in my humble opinion, these companies probably wouldn't have got warning letters if they were not making high risk disease claims, a great reminder that if a company's going to market anything that can be ingested by humans, be truthful, non misleading, and for darn sake, don't use any disease claims.
