It could be worse, but it NEEDS TO BE BETTER! On October 21, 2021, the New York State Office of Cannabis Management held its second public meeting. On the agenda was to discuss the medical patient home-grow regulations. A draft was released verbally, and the state website will soon be updated to read the actual text of the draft. www.Cannabis.NY.gov State law allows 60 Days for public comment. Then, after revisions, a final draft will need to be accepted before it becomes a resolution. ALL of this must be completed before patients can home cultivate their medicine. We will need YOUR comments. Follow us and @empire State NORML for updates on how to submit comments. The state website will also have information soon. Highlights from the meeting for patients: Certified patients 21 years of age and older may cultivate cannabis for personal use with a limit of six plants. (3 mature and 3 immature) Designated caregivers caring for patients under 21 years of age or whose physical or cognitive impairments prevent them from cultivating cannabis, may cultivate on behalf of the patient. Designated caregivers can cultivate no more than six cannabis plants for any patient, however, caregivers cultivating for multiple patients may cultivate one additional cannabis plant for each subsequent patient. Imposes a duty on patients to take reasonable measures to ensure that cannabis plants and any cannabis cultivated from such plants are not readily accessible to anyone under the age of 21. Medical cannabis regulations do not permit home cultivation for personal use for those, not in the medical program.
