Election Commission 24-621 FACTS: NRSC and JD Vance challenge restrictions on political party spending on first amendment grounds. **NOTE: EXPENDITURE - I spend my money. CONTRIBUTION - I give YOU my money to spend** RULE 1: Fed. Election Campaign Act (FECA) of 1971 regulates political spending RULE 2: Buckley v. Valeo 424 US 1 (1976) Under 1st Amd., struck down FECA restrictions on private independent EXPENDITURES "private speech/spending about politics" but retained CONTRIBUTION (donation) limits because contributions weren't direct speech. These rules were for private individuals and groups, restrictions on campaigns and political parties remained. RULE 3: Colorado I 518 US 604 (1996) struck down political party EXPENDITURE limits IF the expenditure was totally independent/unrelated to a campaign. RULE 4: Colorado II 533 US 431 (2001) went the opposite way, retaining party expenditure limits when the party and campaign Collaborated - A collaborated Expenditure was basically a Contribution. ISSUE (1) : Do the restrictions congress has placed on the money political parties can spend in collaboration with campaigns violate the first amendment? ISSUE (2): Should Colorado II be overturned and all political party spending considered protected speech that cannot be restricted?
