A collective bargaining agreement, or collective agreement, is a written legal contract between an employer and the union that represents some or all of that employer’s employees (known as the bargaining unit). The agreement sets forth the negotiated arrangements that will guide and dictate the employment arrangement between the employer and the represented employees (the bargaining unit), subject to any statutory requirements setting forth minimums with respect to employment standards and labour requirements. Provided that those statutory minimums have been satisfied, the collective bargaining agreement sets forth the heightened employment arrangements that the union has been able to negotiate from the employer on behalf of the union-represented employees (the bargaining unit); such that it might result in preferable employee terms as to hourly pay, overtime, vacation, holidays, employer contributions to pensions and benefits, promotions, lay-offs, severance and grievances and mediation/arbitration processes, among others. Once the employer and the union agree to the terms of the proposed collective bargaining agreement, it must be submitted to the bargaining unit employees for a ratification vote. Only once it has been ratified will the collective bargaining agreement have effect over the relations of the employer, the union and the unionized employees. A copy of the ratified collective bargaining agreement will also need to be filed with the appropriate labour department as prescribed by the governing statute. #collectivebargainingagreement #cba
