Summary Court Martial can be convened and held by the commanding officer of any unit (corps, department or detachment) of the regular Army. It can try any person except an officer, JCO or Warrant Officer. The accused must be present at his trial and gets due due opportunity for defense. An accused after his conviction can be awarded any sentence up to one year imprisonment. This session brings out jurisdiction, composition, powers and procedures of summary courts martial. Maj Gen Nilendra Kumar was Judge Advocate General of the Indian Army from 2001 to 2008. Thereafter, he headed Amity Law School, Noida as its Director from 2009 -16. Presently he is the Executive Director of Indian Society of International Law while also heading Lex Consilium Foundation, a charitable company incorporated under section 8 of the Company's Act devoted primarily to legal education.
