Many people file a petition or application for immigration benefits, get a Request for Evidence, Notice of intent to Deny or even a Denial from USCIS based on a statement, confession or evidence obtained without providing the applicant with that evidence. This makes it next to impossible for a person to meaningfully respond or refute the claims or allegations against them. Recently the 9th Circuit Court of Appeals stated that it is unconstitutional for USCIS to deny a case based on “secret evidence” or undisclosed records. USCIS must now provide the person with the records or evidence being used against them so they have an opportunity to respond. This is the essence of due process.
