America’s Founding Fathers envisioned Congress as the strongest branch of the federal government. One thing they didn’t foresee: that Congress doesn’t seem to want that power. The American people seem to have noticed the resulting dysfunction. While presidents and the Supreme Court see their popularity ebb and flow, Congress has had a consistently negative approval rating for over 20 years. So, how did Congress get so weak? Part of the answer is that presidents have steadily expanded their powers at Congress’ expense. Over the last decade, for example, there have been major changes in immigration policy: mass amnesties, huge swings in how many people are let over — or turned away from — the border, etc. Yet not one of those changes came from Congress. They were all enacted unilaterally by presidents. And Congress doesn’t seem to be in a hurry to get its power back. After all, by outsourcing controversial decisions, members protect themselves from blame if something goes wrong. That’s why, according to one survey of House members, Congressmen spend as little as 35% of their time actually making policy. Here’s the thing: Congress exists to represent us.
