Kouri Richins’ lawyer Kathy Nester began cross-examining private investigator Todd Gabler by establishing that he is not a law enforcement officer and never has been. “And the rules and ethics and expected practices of private investigators are significantly different, would you agree with me, than those that apply to licensed law enforcement?” Nester asked on Monday (March 9, day 10). “I don’t know that I would agree with that in every circumstance. A private investigator, when he is hired by a lawyer, is bound to all the ethics that that lawyer is bound to,” Gabler answered. “So if you want to go search a house for six straight days and look at thousands of documents, you don’t need to get a judge to give you permission to do that, right?” Nester asked. “No, I got the permission of Kouri’s lawyers who represented her to do that,” Gabler answered. Gabler, who wore a neck brace on the witness stand because of a recent back surgery, also testified about a phone call he received from Richins on Jan. 19, 2023. “I told her it would be inappropriate and unethical for me to continue the conversation outside the presence of her lawyer,” Gabler said. “I then texted her lawyer and had a phone call with her lawyer about the propriety of her client speaking without her presence. I then requested that Kouri submit to an interview multiple times.” Nester said the point is Kouri “called you to talk to you and tell you her side, right?” “I don’t know what her intentions were. She seemed very angry that I had contacted one of her business associates. I believe that was the reason she called me on that date,” Gabler answered. “And so you never to this day have sat down with Kouri and heard her version of what happened?” Nester asked. “No, despite my repeated requests,” Gabler answered. Today (Tuesday, March 10, day 11) could be the final day of testimony from prosecution witnesses. Detective O’Driscoll of the Summit County Sheriff’s Office is expected to testify.
