Evidence Destruction in a counterfeiting case... Our client, a well-known law firm specializing in matters in involving intellectual property, reached out because they had received an order from a Federal Court judging allowing for an inspection and destruction of infringing goods. The end client is clothing brand that has a very distinct and well-known logo that they display on all of their shirts. In this case the infringing company was producing shirts that a confusingly similar logo on them. Our marching orders were to coordinate an inspection of the subject’s warehouse to inspect for the infringing goods. The first objective was to make sure that the number of garments bearing the infringing mark had been accurately reported by the subject. Then we were to inventory the infringing goods and document this accordingly for the purposes of the case. We were then asked to transport the goods to our office and coordinate the destruction. The inspection went smoothly, and we were able to inspect the warehouse without any issues. After gathering and preparing an inventory list of all infringing goods we need to have them destroyed. In this case we coordinated with a shredding company that we know very well who was willing to help. The garments were cotton shirts and the shredding company said that their trucks were up to the task. Our team spent hours dumping boxes and boxes of shirts into bins so that they could be shredded and then dumped. The great part about the shredding trucks is that they have a video camera setup that we could tap into and record the whole process. This allowed us to provide tangible evidence of the destruction process.
