CAN A LANDLORD PROHIBIT ME FROM SMOKING WEED IN MY HOME IN LAS VEGAS? It is now legal for adults 21 and older to possess up to 1 oz. of marijuana (or up to 1/8 ounce of cannabis concentrate) in Nevada and to consume that marijuana in a private residence. However, landlords and homeowner associations have the right to prohibit marijuana from their premises and evict residents who violate their rules. Marijuana is also still illegal under federal law, so property owners and HOAs are under no obligation to permit its consumption. Leases and CC&Rs typically have clauses about drug usage. Note that consuming marijuana is also prohibited throughout casinos and hotels, including in the privacy of a hotel room. Housekeeping staff who smell or find pot in hotel rooms may inform their superiors, who can then call the authorities. Therefore, tourists are advised not to bring or purchase weed in Nevada. Finally, note that Nevada's secondary, undergraduate, and graduate schools including UNLV and UNR follow a zero-tolerance drug policy for both students and staff, even in the privacy of dorm rooms. Students found in violation of school policy may face expulsion, losing scholarships, and criminal charges for smoking in public. LAS VEGAS DEFENSE GROUP, L.L.C.
