In Australian law, the tort of deceit generally occurs where a person makes a false representation of fact, knowing it is false or being reckless as to whether it is true, with the intention that another person will rely on that representation. If the other party relies on that statement and suffers loss as a result, the law may provide a right to seek damages or other remedies. To establish a claim for deceit, several elements must typically be proven. First, there must be a false representation made by the defendant. Second, the defendant must have known the statement was false, or acted with reckless disregard as to its truth. Third, the statement must have been made with the intention that it be relied upon. Fourth, the claimant must actually rely on the representation. Finally, that reliance must cause loss or damage to the claimant. Fraudulent misrepresentation is closely related and often arises in commercial or contractual contexts. It generally involves a party making a false statement that they know to be untrue, or that they make without caring whether it is true or false, with the intention that the other party relies on it when entering into a transaction. If a claimant successfully proves deceit or fraudulent misrepresentation, the available remedies can be significant. Courts may award damages to compensate the claimant for losses caused by the deception, and in some cases the contract induced by the misrepresentation may also be rescinded, meaning it is set aside and the parties are restored to their original positions as far as possible.
