While their roles are different, they often collaborate to ensure that the process runs smoothly and efficiently. Probate attorneys are responsible for guiding the Estate’s personal representative (“executor” or “administrator”) through the legal requirements of the probate process. They provide legal advice on issues such as inventorying assets, paying debts and taxes, and distributing assets to beneficiaries or heirs. They also represent the personal representative in court if necessary. Probate Realtors, on the other hand, help sell real property owned by the estate. They provide advice on pricing, strategies for marketing, and suggestions for preparing the property for sale. Realtors also become a referral source for reputable service providers such as contractors, property managers, demo/clean out specialists, and companies that provide estate sale services. When a property is going to be sold as part of the administration of the estate, a probate Realtor and probate attorney will work together to ensure that the sale of the property complies with all legal requirements. In addition to proper court filings, extensive disclosures, waivers, and addendums are usually a part of the negotiations. Title may need to be cleared and other unknown liens or judgements may have to be addressed. Occasionally, holdover tenants, trespassers or squatters become a problem. Similarly, sometimes vandalism occurs which, if not addressed, can delay or even stop the sale or closing. The attorney and the probate specialist should work together to get these problems resolved and keep the transaction moving forward.
