For an innocent State to terminate or to suspend a treaty, the breach by the State in default must be material. A material breach invoked by a state as a reason for termination or suspension in whole or in part, especially when that breach is a repudiation of a treaty or a violation of a provision crucial to the accomplishment of the object or purpose of the treaty. Third, the impossibility of performance means there is permanent disappearance or destruction, of an object essential for the treaty's execution, provided that it is not caused by the State invoking it. Fourth, In the event of a fundamental change of circumstances. And lastly, Where the treaty conflicts with a new peremptory norm of general international law. On the other side, a multilateral treaty does not terminate because the number of parties falls below the minimum necessary to bring it into force, unless it so provides, nor is a treaty terminated by severance of diplomatic or consular relations. #internationallaw #law
