An Oregon federal judge has dismissed the Department of Justice’s lawsuit seeking access to sensitive voter-registration data — and warned that the government may have overstepped its legal authority. In a sharply worded ruling, the court refused to give DOJ its usual “presumption of regularity,” the legal benefit of the doubt federal agencies almost always receive. The judge concluded that the federal statutes DOJ relied on did not authorize sweeping demands for unredacted voter data, emphasized the states’ constitutional role in administering elections, and held that Oregon law barred disclosure of the information at issue. The opinion went further. The court cited DOJ statements about creating a nationwide voter database and raised concerns that such information could be used for immigration-enforcement purposes — calling that possibility “chilling” and warning it could discourage voter participation. Because DOJ has filed similar voter-data lawsuits around the country, this ruling could have implications far beyond Oregon.
