Illinois cannabis license new program implementation: adult-use cannabis sales began in early 2020 and have proven to be a lucrative opportunity bringing in over 1 billion dollars in sales in 2021. Originally, the Illinois Department of Financial and Professional Regulation developed a merit-based application process that ranked applicants within a scoring system that the department designed. Due to a lack of consistency with scoring, unsuccessful applicants appealed this process leading to significant delays in terms of licensure with licenses yet to be issued 2 years after the program started. In an effort to create a more fair system and avoid future litigation, Illinois has announced it is currently implementing a lottery-based system for future licenses. The department announced it plans to issue an additional 50 licenses in 2022 and also plans on using the lottery system to issue licenses previously held up due to inaccurate scoring and other inconsistencies. Here are a few of the key differences due to the implementation of a new licensing process: 1. Previously dispensary owners could hold ownership in multiple retail licenses, updates now only allow for owners to have control or interest in one retail license. 2. The original license application required a significant amount of preparation to apply for licensure with very specific plans relating to operations and business planning. The new application will be simplified with all qualifying applicants being entered into a lottery for license allocation. 3. Rather than scoring additional points for social equity status, this new process requires that applicants qualify as social equity applicants before applying. 4. Corrective lotteries are being implemented to assist with the licensure for applicants held up in the original licensing process due to litigation. While currently, the Illinois cannabis application process is not open for first-time applicants, this is expected to change as the state announced it will be issuing an additional 50+ licenses in 2022.
