In 1947, India got its first Indian Chief Justice in Harilal Kania, who became the CJ of an All Indian Federal Court. But it took two more years for India to abolish the process of appeals to the Privy Council that existed on foreign lands. The top most court of the country finally belonged to Indians. And on 28 January 1950, two days after India became a sovereign democratic republic under a new Constitution, the Princes’ Chamber of the old Parliament House hosted the first sitting of the Supreme Court of India. Today the top court consists of 33 judges, sitting in multiple benches of nine, seven and five, and many more division benches. With a pendency of close to 80,000 cases, the Supreme Court of India manages to clear around 5000 cases every month. In more ways than one the Indian Supreme Court is a unique institution with its own unique flaws. The need to uphold the Access to Justice paradigm is being debated now, more than ever. So is the importance of preserving the role of the Supreme Court as the “people's court”. There are strongly divided opinions about the functioning of the apex Court and the importance of judges' independence in deciding cases. At the Wayanad Literature Festival, an eminent panel of legal luminaries is coming together to showcase the institution through a cultural and critical lens. Joining us is Justice Jasti Chelameswar, a former judge of the Supreme Court of India. who retired as the second most senior Supreme Court judge. He also served as the Chief Justice of the Kerala High Court and the Gauhati High Court. He was a part of the division bench of the Supreme Court which held Section 66A of the Information Technology Act 2000 as unconstitutional. He was also part of the bench of the Supreme Court that clarified that no Indian citizen without an Aadhaar card can be deprived of basic services and government subsidies. Also on the panel is Shyam Divan, a senior advocate at the Supreme Court of India. His areas of practice cover constitutional law, and most branches of civil litigation including banking, securities law, arbitration, administrative law, and environmental law. Adv Divan is the co-author of Environmental Law and Policy in India. He received the 2021 International Privacy Champion Award from the Electronic Privacy Information Centre (EPIC) for his role in a set of privacy protection cases. To speak about reform of legal and judicial institutions, joining us on this panel is Dr. G Mohan Gopal, the former Director of the National Judicial Academy of the Supreme Court of India and the founder Chair of the National Court Management Systems Committee of the Supreme Court of India. Prof. Gopal is former Vice-Chancellor of the National Law School of India, Bengaluru. He continues to work actively on current judicial and legal issues. Hosting this panel is Leena Gita Reghunath, one of the best investigative journalists India has seen, who has firmly left her imprints on legal journalism, is bringing together this panel to ask the most pertinent questions about the apex court. Leena’s stint with the Caravan and later with the Supreme Court Observer have given her the rich experience of tracking the most contemporary legal developments in the country.
