If you're facing the charge of child pornography, there's a lot that we need to assess very early on with your case. Child pornography obviously is one of the most serious crimes that a person can be charged with and it is heavily prosecuted, but there is a spectrum to this crime. The most important thing that we need to assess right off the bat is what is the nature of the alleged child pornography? What is it depicting? What are the alleged ages of the subject in those images or videos? There's obviously a huge difference whether this is a subject who's depicted to be between 16 and 17 years old versus somebody who might be under the age of 14. Then we have to look at what is the actual content? Is this simply sexual poses? Is it in depicting any form of actual intercourse or in some of the more egregious cases that we see, does it involve anything that might involve a torture or any form of a rape? The next thing that is very important for us to examine is what was the intent and what were the actions that you are accused of doing. Are you accused of simply possessing this pornography? Are you accused of distributing it? Or on the far end on the worse end, are you accused of actually generating and creating these images? But again, with all of these serious crimes, intent is the most important aspect that we need to assess in order to build the most successful defense for you. For example, we had a client who was accused of possession of child pornography, who was not possessing it for any form of self-gratification but actually was a member of academia and was actually writing a research paper on the topic but had not gone through the proper legal channels of coming into possession of this content. But that was a huge difference in his case, that resulted in being able to mitigate and really bring down these charges. The most important thing that our clients are facing with child pornography charges is the mandatory lifetime sex offender registration.
