North Dakota Lady Charged with APC While Passing Time with a Friend

SUNDRE, ND - On July 22nd, 2020 at 1:22AM, a deputy and sergeant with the Ward County Sheriff's Department noticed a truck pulled off the side of the road with keys on the ground. The deputy approached the suspect and asked for her identification to which she provided. Following a lengthy discussion with the sergeant on scene, the deputy approached the suspect and asked whether she had drank earlier in the evening. The suspect claimed that she had consumed liquor at a local establishment during a memorial service. While speaking with the deputy, the sergeant discovered a one-hitter pipe on the ground that the suspect claimed was not hers. She eventually agreed to perform a field sobriety test. During the horizontal gaze nystagmus test, the suspect displayed vertical nystagmus, a lack of smooth pursuit and distinct and sustained nystagmus at maximum deviation in both eyes, and had trouble following instructions of keeping her head still and following the stimulus with just her eyes. For the walk-and-turn test, the suspect performed an improper turn, missed heel-to-toe multiple times, stepped off the line multiple times, and began walking before the deputy finished instructions. The suspect further put her foot down multiple times and was unable to maintain her balance during the entire 30 second timeframe during the one leg stand test. Following the conclusion of the field sobriety test, the suspect was offered to participate in a preliminary breath test. Because the suspect was under investigation for being in actual physical control (APC) of a vehicle and not driving under the influence (DUI), there was no penalty for her to refuse the test. The suspect eventually refused to provide a preliminary breath alcohol sample and subsequently was arrested for APC. While the suspect was in custody, the passenger denied ownership of the drug paraphernalia found earlier by the sergeant. Furthermore, after an exhaustive search, the keys to the vehicle were never found on scene. The suspect was then taken to the Ward County Jail for further processing.
