Society of New York Hospital, 105 N.E. 92 (1914) Doctors in a nonprofit hospital surgically removed a lump from a patient’s body without her consent. Could the hospital be sued for the actions of the doctors and nurses involved in the surgery? That was the question for New York’s highest court in the nineteen fourteen case Schloendorff versus Society of New York Hospital. The Society of New York Hospital was a nonprofit hospital committed to providing care for all. Wealthy patients paid just seven dollars a week for care, while poor ones paid nothing. In January of 1908, Mary Schloendorff went to that hospital, complaining about a stomach problem. After several weeks of care, a doctor found a lump and consulted a visiting surgeon, who recommended surgery. Schloendorff emphatically refused any surgery, but she agreed to an ether examination to identify the lump. While Schloendorff was under the ether anesthesia, the doctors surgically removed the lump, a fibroid tumor, from her body. After the surgery and allegedly because of it, Schloendorff developed gangrene in her left arm and lost several fingers. Schloendorff sued the hospital in New York state court for the actions of the doctors and nurses involved in the nonconsensual surgery. The trial court ultimately dismissed her claim, and she appealed to the New York Court of Appeals. Want more details on this case?
