Women’s Action Forum has highlighted 7 major progressive changes in rape and sexual assault cases in Pakistan (see report by Maham Ali). Here they are: 1. Rape not Zina Section 375 PPC: Rape (zina bil jabr) separated from zina (adultery) and no longer part of Hudood Ordinance. This change occured with Protection of Women (Criminal Law Amendment) Act 2006 and Criminal Law (Amendment) (Offense of Rape) Act 2016. 2. Impeding investigation Section 166(2) PPC: Public servants can do three years prison for impeding investigation of rape. 3. Deadlines on cases Section 344(A), CrPC: Cases decided within 3 months or will be sent to Chief Justice of the High Court, Appeal within six months, cases wrapped up in a year’s time. 4. One can’t give ID of victims Section 352, CrPC: Trial to be in camera, judge’s chamber or in a private place. 5. Female supervision Section 164A CrPC, Section 161A CrPC: Investigation Officer (IO) will register the FIR in the presence of a female police officer or female family member. 6. DNA in rape cases Section 164B CrPC: DNA shall be collected from victim with consent 7. Can’t bring up sexual history: Section 151(4) Qanun-e-Shahadat (Law of Evidence) 1984 has been deleted.
