Self defense does not always apply. Stand your ground does not always apply. If you leave the scene of the initial confrontation, and return with or without a weapon then you likely lose any self defense claim. Client was always courteous, reliable and appeared to be a very good person. Unfortunately, the decision to go after the person that attacked him was the wrong decision. The penalty received could have been much worse. When the judge heard the facts and the offer, I saw a look that questioned the result. Something like, why is this being offered. When discussion was allowed I explained the self defense issues that were reviewed and the state was quick to say that the victim agreed to the sentence. Remember a judge can choose not to accept an offer agreed to between the parties. Important point in this case was that the victim arguably was the initial aggressor. Had my client simply called the police, the victim would have been arrested and charged with a felony. All the way around this case could have been much different. Think before you act.
