February 7, 2017. Jefferson County, Kentucky. The Facts: My client, a CDL driver, was accused of following another vehicle too closely. Under Kentucky law, following under 250 feet behind another vehicle is against the law. However, the Federal standard is 1 second breaking distance for every 10 feet of travel distance. I borderline tried judicial nullification in this case and the judge didn't go for it. He did give my client the minimum fine, though. May be I should have went with a jury? What do you guys think? Does my argument have any merit?
