Miranda Warnings or, “The Reading of Your Rights,” is often misunderstood concept of criminal law and procedure. Miranda Warnings involve custodial interrogations. What does that mean? That simply means that the a person has to be in “custody” and law enforcement has to be asking that person questions (interrogations). In this video, Partner Matthew Crowley simplifies Miranda and explains when the warnings apply and when they do not apply. Miranda Warnings: do not apply to statements made when a person is not in custody. Custody, generally, means that the person feels that they are not free to leave at the time of the questioning. It also does not apply to statements which are offered by the person which are not in response to police questioning. If the government wants to use your statements against you, and you were in “custody” and being “questioned” (interrogated), they need to establish you were read your Miranda Warnings. Otherwise, whatever you say cannot come into evidence to be used against you. Rule of Thumb: You have the right to remain silent. Don’t give evidence against yourself. Stay quiet in the face of police questioning or investigative scrutiny.
