The Transgender Persons (Protection of Rights) Amendment Bill, 2026 was introduced in the Lok Sabha by the Ministry of Social Justice and Empowerment to amend the Transgender Persons (Protection of Rights) Act, 2019. The bill proposes several key changes aimed at strengthening legal protection for transgender persons and improving the implementation of the existing law. One major change is the revised definition of transgender persons, which includes socio-cultural identities such as kinner, hijra, aravani, and jogta, along with certain biological variations. However, the amendment excludes self-perceived gender identity and removes Section 4(2) of the 2019 Act, which previously allowed legal recognition based on self-identification. The bill also proposes the creation of a medical verification board, headed by a Chief Medical Officer or Deputy CMO, to assist authorities in verifying transgender identity. This marks a shift from the earlier system where individuals could obtain a certificate of identity from the District Magistrate based on self-perceived identity without medical examination. Another important provision is the introduction of graded punishments for offences against transgender persons, including abuse, forced labour, abduction, and forced identity changes. In severe cases, the punishment can extend up to life imprisonment. The amendment also proposes changes to the National Council for Transgender Persons, ensuring rotational representation from State Governments and Union Territories. Additionally, individuals receiving a certificate of identity will be able to update their official documents accordingly.
