When speaking with the bank, it's common to receive inconsistent, conflicting, and often misleading information. This can include payment amounts, due dates, and "special arrangements" that sound promising, but will ultimately make the situation much worse for you. For this reason, I always encourage homeowners to keep good records of all correspondence with their mortgage company. Lenders will try to threaten and intimidate you, while asking you for the same documents over and over. Homeowners who do not have legal representation are an easy target and often get taken advantage of. Unfortunate examples of these predatory tactics include: pretending to work with you on a solution while, at the same time, continuing the foreclosure process. Mortgage companies offer you the moon, and even tell you to stop making payments. They often don't tell borrowers that when in the trial period for a loan modification, your payments are not being credited to your mortgage balance. Add to this a mountain of confusing, time-consuming paperwork and it's no wonder that so many homeowners are desperate for help in these situations.
